Complaint Investigation Report
The investigation revealed the following: Regarding the allegation,” Facility illegally evicted resident .”. It’s being alleged that C1 is being evicted in February of 2024 for poor behavior due to complaining about the staff. LPA Spaeth interviewed 6 out of the 7 staff members. 2 staff interviewed state the client exhibits poor behavior. 4 staff denied C1 exhibits poor behavior. 6 staff members confirmed C1 has verbalized they would like to move to another facility. 3 out of the 4 clients state C1 has not exhibited poor behavior, has not been observed complaining about the staff’s service, or stated they want to move out of the facility. One resident declined to speak to LPA Spaeth.
A program end notice was presented to C1 on 10/16/2023 which states the facility is not the best fit for the client’s needs and that C1's needs require a different environment. The Appraisal Needs and Services Plans dated 7/19/2023 was reviewed by LPA Spaeth. LPA Spaeth observed that the plan did not state any behavioral concerns by staff and stated the client demonstrated improvements regarding the client’s emotions. Therefore, the client’s needs and services plan does not support the reasons for the program to be ended at the facility.
Based on the interviews with staff, residents and a record review, the above allegation is found to be Substantiated . California Code of Regulations, Title 22 Division (6) and Chapter (8) are being cited on the attached LIC9099-D.
An exit interview was conducted, and a hard copy was provided with appeal rights.
