C1 declined to be interviewed for the investigation. Record review of C1’s behavioral plan at 11:00 a.m. today revealed staff were to provide “immediate response…, blocking, and immediately transport to cars”. Based on interviews and record review, there is insufficient evidence to verify the above allegation. Therefore, the allegation is deemed UNSUBSTANTIATED at this time.
Regarding the allegation "Staff did not report incident to client's responsible party" it was alleged staff was mandated to report an altercation to C1’s responsible party and did not. It was alleged S1 hit C1 after C1 ran from the facility vehicle. A bystander stole the keys from the facility vehicle and later returned them. Interview with the house manager, Staff #4 (S4), at 10:30 a.m. today revealed they did not report the incident to C1’s responsible party since C1’s elopement from the vehicle was a common behavior. The incident that occurred was a verbal altercation between S1 and the bystander. Since C1’s welfare or safety was not in danger, the facility felt no need to report the incident. At 10:40 a.m. today, S4 showed LPA behavior tracking sheets which documented C1’s eloping behavior. Interview with S2 confirmed staff documented the incident. Record review of C1’s facility file revealed C1’s eloping behavior was part of their behavioral plan. Staff documented the incident internally. Based on interviews and record review, staff did not report the incident to C1’s responsible party as it did not meet the criteria as a mandatory report. The facility did not violate any Title 22 regulations. Therefore, the allegation is deemed UNSUBSTANTIATED at this time.
No immediate health or safety concerns were observed during today’s visit.
