Complaint Investigation Report
The investigation revealed the following:
In regards to allegation, client was sexually assaulted while in care. IB Investigator O. Spandola was assigned to interview Client #1 (C-1) and determined that a further investigation is not warranted. C-1 denied being sexually abused. A family member was also interviewed and reported to the investigator that C-1 has a history of fabrication and likes reporting sexual or physical abuse to seek attention. LPA Chan interviewed 3 additional staff members who have worked with C-1. Staff denied sexually abusing any clients and 2 of the staff indicated that C-1 had made false allegations while residing at the facility. Based on C-1’s most current Individual Program Plan (IPP) dated 8/17/22, it indicates client makes “verbal statements that are known to be untrue or is later found to be untrue. LPA interviewed C-1's regional center service coordinator who confirmed that client has a history of fabrication and has made the same allegation in the past.
LPA interviewed 3 clients today. They stated the staff are good to them and do not touch or speak to them inappropriately.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
An exit interview was conducted with Administrator Wilson. A copy of this report along with the appeal rights were provided.
