The inspector’s account

Licensing Program Analyst (LPA) Teresa Camara conducted a case management - incident visit regarding a self-reported incident which took place on 9/5/2024 involving Client 1 (C1) as well as a death report for 8/22/2024 death of Client 2 (C2). LPA was joined by Tri-Counties Regional Center (TCRC) Quality Assurance Specialist (QAS) Liz Aced-Arnett. LPA and QAS met with Supervisor Jennifer Chavez and explained the reason for the visit. The Program Manager Mary Sawyer is currently out on leave of absence.

At 9:45 a.m. LPA reviewed the file for C2. It stated C2's health condition was declining. LPA spoke with Case Manager Alejandra Rivera who has been in contact with C2's family and they have agreed to forward the death certificate as soon as they receive it. C2 did not pass away at the facility but had remained a participant at the facility at the time.

At 9:28 a.m. LPA and QAS met with Supervisor Chavez regarding the incident on 9/5/2024 between C1 and Staff 1 (S1). It was reported by C1 and Staff 2 (S2) that S1 mocked C1. It was also reported that S1 threatened to take C1's recyclables if C1 kept stopping for rest breaks during their outing. According to Supervisor Chavez most of the internal investigation of the incident was completed by their Human Resources (HR) Representative Yasmin Corral. At 9:51 a.m. LPA and QAS conducted a phone interview with HR Corral who stated they reviewed statements from C1 and S2. They interviewed S1 who admitted to "motivating" C1 to continue walking by stating they would take their recyclables. S1 made no notation of the incident in their case notes. Due to S1's lack of documentation of the incident, S1 was terminated. At 10:15 a.m. LPA and QAS interviewed a regular participant Client 3 (C3) in S1's group who stated S1 was "cool" and they liked S1. C3 denied observing any problematic issues with S1. In addition, management stated they had not had prior discipline for S1.

No deficiencies were observed. Supervisor Chavez will forward a copy of the death certificate to LPA as soon as it is received from C2's family. Exit interview conducted and report issued.
