Complaint Investigation Report
In regard to the allegation “Staff inappropriately touched resident.”, it is alleged that staff touched C1 in his/her private parts. This allegation was investigated by Investigations Branch (IB), investigator J. Canto, which revealed the following: During interviews with Regional Representative, it was revealed that C1 has a history of making allegations when wants and needs are not met. C1 made allegations against previous placement. Contact with Pomona PD Officer Melgoza indicated the allegation of potential sexual abuse/battery to be unfounded. Investigator Canto interviewed C1 and C1 was unable to give specific dates, times, and details of incident. LPA Gutierrez interviewed Administrator and three (3) staff and four out of four (4) all stated that no inappropriate touching of a client has ever happened. During interviews with one (1) resident it was stated that staff has never touched them inappropriately.
In regard to the allegation “Staff has inappropriate interaction with resident.”, it is alleged that staff hugs, kisses clients on the head, and tickles clients. During interviews with Administrator and staff four (4) out of four (4) stated that they never acted inappropriately with clients or witnessed staff act inappropriately with clients. S1 stated that they have a client that when having behavior issues hugging will calm him/her down. During interviews with clients one (1) out of two (2) clients stated that they have not had any inappropriate interactions with staff. C2 stated that any interactions with staff has never been in a bad way. C3 is non-verbal. Interview with Investigations Branch (IB), investigator J. Canto reveled that C1 could not describe any inappropriate interactions with staff.
In regard to the allegation “Staff hit resident”, it is alleged that staff hit clients. During interviews with Administrator and staff four (4) out of four (4) stated that they have never hit a client in care. During interviews with clients one (1) out of two (2) clients stated that they have never been hit by staff. C2 stated there was an incident with a staff member that is no longer there. LPA asked C2 if he/she was hit and C2 stated no. C3 is non- verbal.
