The inspector’s account

C1’s interview revealed that client was attempted to take C2’s possession away from C2 in an aggressive manner without asking C2 for permission. Therefore, C2 defended oneself. No witness or staff was around during the incident. Per staff interviews, four (4) out of four (4) staff denied the allegation. It revealed that staff had taken precaution to prevent clients from hitting other clients. If such incident happened, staff would intervene immediately, re-direct clients' attention, de-escalate the situation, and investigate the incident afterward. Per record reviews, facility had filed an incident report to licensing, care coordinator agency and ombudsman to report the incident. Administrator had notified client’s responsible party and conducted an internal investigation of the incident. It was a single incident. Besides, staff had completed their In-service training on proactive / assault crisis training on preventing physical altercations between clients.

Based on the information obtained during the investigation, interviews with staff/clients, review of client files and LPA's observation, the investigation did not reveal any evidence to support the allegation mentioned above.

Although the allegations may have happened or are valid, there is not preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegation is UNSUBSTANTIATED.

LPA conducted an exit interview with Joyce, administrator and a copy of this report was provided.
