The inspector’s account

During interviews with the clients, eleven (11) out of twelve (12) did not corroborate the allegation. One client interviewed stated that they do not feel that the staff are not creating a restrictive environment for themselves or the other clients in care. Another client interviewed stated that they are independent in the facility and do not believe the facility restricts their independents or their rights. During interviews with the staff, none of them corroborated the allegation. One of the staff interviewed stated that they are following their house rules with medications which state that all medications must be delivered to the office, and that no medications can be kept in the residents’ rooms. Another staff member who was familiar with the situation stated that the client in question had filled this particular medication at their own pharmacy rather than providing the prescription to the office, and so they were not aware the medication was ordered until recently, and have since asked the doctor to send the medication order to them so they can store the medication and keep it on record. During record review of the house rules, it does indicate that no medications are allowed to be kept in client bedrooms. Additionally during record review of the client's physician report, it indicates that they are not able to administer and store their own medications.

Based on statements and interviews conducted with staff, clients, review of client files and facility file records, there was not enough supportive evidence to concur with the reported allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED .
