The inspector’s account

Per clients interviewed, clients residing at the facility are following smoking rules. Interviews with staff revealed 2 out of 2 staff stated the facility has smoking rules and the clients mostly smoke in front of the house in the sidewalk while walking back and forward. LPA attempted to interview neighbors to the left and right of the house and was unable to interview any of the neighbors. Administrator stated that within the past two months a homeless individual has come to the facility claiming to have leave at the facility prior to 2008. This individual attempts to break into the house. Administrator has observed video footage in which is observed smoking in the backyard or front porch in the middle of the night. Administrator and clients have called the police department during those incidents. During the visit LPA observed sign in front of the house on the grass area regarding smoking policy. Between 12:24pm to 1:24pm LPA observed three clients come to the front of the house and smoke in the sidewalk. The sidewalk is at least over 20 ft away from the facility’s porch and the building to the left or right are further away from the area in which the clients smoke. LPA observed the facility and did not notice smell of smoke inside the facility. Per Pasadena’s Smoking Ordinance there is no smoking in common areas in a multi-living home/facility. Smoking is to be 20 feet away from any doorway, window, or vent. Unless while passing by. Based on observation and Pasadena’s ordinance the clients are following the smoking ordinance of the city.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED .
