The inspector’s account

One (1) of three clients confirmed the allegation. One (1) client heard the commotion, and one (1) client could not corroborate that allegation. On 1/30/2026 C1 asked staff if C1 could go to mall with them. Staff asked C1 to ask C1 staff. C1 asked S5 if C1 could go to mall outing and S5 told C1 that C1 could not on this day due to lack of proper transportation for C1 and C1 wheelchair. C1 became angry and C1 tossed objects onto the floor. What follows are LPA's Observations from video recording from facility. S5 intervened and took C1 to the outside parking lot by the dumpsters. C1 was visibly upset and saying something to S5. (audio was muffed). The video shows two inappropriate incidents that occurred between C1 and S5. First incident shows S5 pulling the back of C1 wheelchair all the way back to the ground and placing C1 on the ground. Second incident shows C1 being pulled back from the back of C1 jacket as C1 was maneuvering in the front of a vehicle. Video shows C1 being pulled away from the car and bent over head over feet until C1 landed on the floor awkwardly. S5 admits pulling C1 from the jacket. Based on interviews, and video review, there is sufficient evidence to substantiate the allegation.

Based on interviews conducted and records reviewed, the preponderance of evidence standard has been met, therefore the allegation is found to be substantiated. California Code of Regulations, Title 22, Division 6 and Chapter 1 are being cited on the attached LIC 9099D.
