The inspector’s account

The investigation revealed the following:

Allegation: Staff discriminating against resident.

It is alleged that staff are withholding C1 from being able to live independently, as C1 is no longer conserved and is believed that C1 should be able to discharge from facility and be granted release of their full VA benefits. LPA interviewed 5 staff and 5 out of 5 staff denied the above allegation. Interview with S2 revealed that since C1’s release of conservatorship 7/7/25, the client has regressed and their plan for post discharge is not a solid plan that gives both S2 and C1’s psychiatrist full confidence that C1 is ready, as this document to be signed is putting their credentials on the line its imperative that they are completely confident that C1 is fully ready to move forward. Interviews with 4 staff and review of the MAR revealed that C1 has multiple missed/refused medications in the past 3 months a total of 9 medications have been missed/refused from May-July 2025. LPA spoke with VA operators and it was confirmed that in order for an individual to be released from a Fiduciary Program (which C1 is a part of), a letter of competency will need to be received and has to be signed by a licensed doctor (behavioral health doctor) and must be provided with supporting medical documents that clearly indicate this individual is ready to be released from the program. LPA interviewed 5 clients and 5 out of 5 clients denied the above allegation and stated that although it may take time for the discharge process they don’t feel that staff are preventing them from moving forward and living elsewhere, its merely a matter of paperwork, getting funds released and finding placement.

Based on statements and interviews conducted with staff/clients, and review of client files, there was not enough supportive evidence to concur with the reported allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED .
