The inspector’s account

Allegation: Staff does not prevent resident from being verbally abused by another resident. Per Reporting Party and staff interviews with the Administrator and six out of six staff it was revealed that Client one (C1) has verbally fought with Client two (C2) on three occasions in the last four months. Four out of four client interviews revealed that C1 has verbally fought with C2 on three occasions in the last four months. The Administrator and six out of six staff interviewed revealed that staff intervenes immediately when these incidents occurred. Four out of four clients report that staff intervenes immediately when these incidents occurred. All interviewed stated staff is trained to redirect C1 and separate clients when this occurs. Four out of four clients interviewed confirmed redirection and separation is practiced by staff when verbal arguments between clients occur. Interview with Administrator and six out six staff revealed that C1 and C2 eat most meals separately and engage in most activities separately which also minimizes chances for verbal confrontation. All clients in facility have private rooms to ensure personal space. Staff interviews and record reviews revealed that facility has a behaviorist whose recommendations are followed on how to address verbal arguments that arise with clients. Records review revealed C1 has a current IPP to guide staff interaction. Staff 1-6 are shown by records review to have Direct Service Provider training that includes training about Personal Rights of clients. The investigation did not reveal a preponderance of evidence to support the allegation.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

LPA Mallett conducted an exit interview with Administrator Juanito Paguio and a copy of this Licensing report was provided.
