The inspector’s account

The details of the complaint alleged that consumers touch each other in the restroom without supervision. On 08/01/24, from 10:00am-1:00pm, LPA interviewed staff (S1-S4) and clients (C1-C8) regarding the allegation. 4 of 4 staff (S1-S4) denied the allegation that the Staff do not prevent inappropriate touching between clients. 4 of 4 staff (S1-S4) interviewed stated that they have not had any reports of inappropriate touching between clients in the restroom or otherwise. And have not observed this type of behavior in their clients. They further state that they address this type of behavior in their in-service meetings with staff to prevent these types of behaviors from starting. LPA reviewed the latest in-service training for De-Escalating Behavior/Diversity & Disability (Dated: 07/15/2024) and team meeting sign-in.

Additionally, staff state that clients are taught about personal space and boundaries; and how to respect that space without touching one another inappropriately. S1 stated that all clients that participates in the program must be independent enough to use the restroom without assistance. While there is no supervision in the restrooms there are cameras outside of the restrooms. And no one has reported any inappropriate touching in the restroom, stated S1.

LPA interviewed C1-C8 about the allegation and 8 of 8 clients that were interviewed denied the allegation that Staff do not prevent inappropriate touching between clients. All Clients interviewed stated that no one in the facility, client or staff, has touched them in an inappropriate way in the restroom or other parts of the facility. They further state that they are happy with the care and supervision they are getting at the program.

Based on interviews and records reviewed, there is insufficient evidence to support the allegation that the Staff do not prevent inappropriate touching between clients. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated .

An exit interview was conducted with Rebecca De Fiesta Flores, Program Manager, and a hard copy of this report was provided.
