The inspector’s account

On 07/19/24 LPA Villegas interviewed ED regarding the allegation above, ED denied the allegation above and stated sharps nor needles have been observed on the facility premises. Per ED the day program shares a parking lot with an urgent care, orthodontist, a tattoo shop, a gym, and a storage unit building. ED also reported there is some construction taking place on an empty building located on the left hand side of the day program. On 07/19/24 LPA interviewed S1-S4 regarding the allegation above, 4 of 4 staff interviewed denied the allegation above and reported sharps nor needles have been observed on facility grounds. On 07/19/24 LPA interviewed C1-C8 regarding the allegation above, 8 of 8 clients interviewed denied the allegation above. On 07/19/24 LPA and S4 conducted a tour of both the inside and outside of the facility, LPA did not observe any sharps, needles nor hazards on facility property accessible to clients. LPA also observed and confirmed that the Day Program shares a parking lot with an Exer urgent care, orthodontist office, a gym, and a tattoo shop. During the tour of the outside of the facility LPA observed construction taking place on a building to the left of the day program.

Allegation: Staff do not ensure facility is maintained in a clean condition

It is being alleged that the facility is dirty and unsafe for the clients.

On 07/19/24 LPA Villegas interviewed ED regarding the allegation above, ED denied the allegation above. Per ED, there is a daily cleaning schedule that is posted and is also accessible to staff on an app called "SLACK" that is used by the day program which list the cleaning task for each staff to perform at the end of their shift. ED also reported that an outside cleaning company (JC Maids) conducts a deep cleaning once a week before the clients arrive to the day program. On 07/19/24 LPA interviewed S1-S4 regarding the allegation above, 4 of 4 staff interviewed denied the allegation above and reported staff are assigned a cleaning task daily and reported the day program is deep cleaned once a week. 07/19/24 LPA interviewed C1-C8 regarding the allegation above, 8 of 8 clients interviewed denied the allegation above and reported that the staff cleans the facility. On 07/19/24 LPA and S4 conducted a tour of both the inside and outside of the facility, LPA observed every room, common areas, walkways and exits to be clean and free of debris/hazards. LPA reviewed invoices from JC Maids and confirmed the day program is being deep cleaned once a week.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation(s) are unsubstantiated.
