The inspector’s account

Between 09:00AM and 1:00PM, LPA interviewed five (5) clients and four (4) staff. Interviews revealed that all five (5) clients and all four (4) staff have denied the allegation has taken place. Client one (C1) has stated, “thank god that doesn’t happen here.”. Record reviews revealed two (2) out of four (4) interviewed staff have conducted the "Mandated Reporter" training, on January fifteenth, 2024 (01/15/2024). Additionally all four (4) out of four (4) staff have conducted "Reporting Elder and Dependent Adult Abuse in California" training, through RELIAS, on various dates between 2021 and 2024 which is initially conducted during staff's on-boarding.

Based on record reviews and interviews conducted, the preponderance of evidence standard has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred. Therefore, the above allegation has been Unsubstantiated.

Regarding the allegation, “Staff leave clients unattended.”, it has been alleged that staff leave clients alone in the van and while clients are outdoors from the facility.

Interviews revealed that all five (5) clients and all four (4) staff have denied the allegation has taken place. Record reviews have shown that the ICAN (California Abilities Network) fleet are equipped with internal and external video footage. The fleet are also equipped with GPS and the video program logs all transit activity. Furthermore, client five (C5) has stated, "The coaches know the rules." and that "they always stick together with us.". Additionally, staff one (S1) noted that, "there is always a 3:1 ratio of clients to coach." Based on record reviews and interviews conducted, the preponderance of evidence standard has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred. Therefore, the above allegation has been Unsubstantiated.

Regarding the allegation, “Staff do not keep client's information confidential.”, it has been alleged that staff share medical information with strangers without their consent.

Interviews revealed that all five (5) clients and all four (4) staff have denied the allegation has taken place. Record reviews revealed all four (4) interviewed staff have conducted the "Essentials of HIPAA" training, through RELIAS, on various dates between 2021 and 2024. Furthermore, all face sheets, without clients' pictures, are made available to the fleet team. Each face sheet is coded, which relate to a specific client, in order for the staff to become more familiar with the client's being handled during each day. Additionally, the same face sheet will only be provided to medical professionals during a potential medical emergency. Based on record reviews and interviews conducted, the preponderance of evidence standard has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred. Therefore, the above allegation has been Unsubstantiated.
