Complaint Investigation Report
Allegation #1: Staff yelled at a client while in care.
It is alleged that staff yelled at a client while in care. Regarding this allegation it was reported that Client #1 (C1) and the Administrator were at Walmart for an outing where there was an accident in the candy isle and some candy was spilled. C1 misunderstood a Walmart employee’s wink as the ok to pocket one of the spilled candies. When C1 and the Administrator were at the checkout, the Administrator began to yell at C1 in front of others asking why C1 was stealing. During the interview the Administrator denied this allegation stating that the incident did not happen like it was reported. The Administrator stated that they noticed that C1 had pocketed a candy based on the observations of the cashier and C1’s suspicious behavior. Administrator states that they were simply addressing the situation in the moment that it was discovered that C1 had a candy in their pocket and that at no point did the Administrator yell at C1. Interview with two (2) out of three (3) clients revealed that Administrator did and has in fact yelled at clients while in the presence of others. Furthermore, it was revealed by clients and staff that other staff members have yelled at clients on multiple occasions. Interview with clients and staff members revealed that that Administrator admitted to yelling at C1 and then recanted the admission. Therefore, based on observations and interviews this allegation is deemed Substantiated.
This is a repeat violation and a civil penalty will be issued. Please see LIC9099-D and LIC421FC.
