Complaint Investigation Report

Allegation: Uncleared adults are working at the facility.

It is alleged that there is uncleared adults working at the facility. Regarding this allegation it is reported that there are staff members providing one on one (1:1) care to clients without a proper background clearance. LPA interviewed Administrator and it was revealed that Staff #1 (S1) has been proving care and supervision to Client #1 (C1) on Thursdays, Fridays, Saturdays and Sundays from seven (7) pm to seven (7) am for a period of approximately one (1) year. Administrator admitted to not clearing S1 prior to allowing S1 to provide care and supervision, depending only on third party vendor Right Choice In Home Care sending S1 to the facility. LPA reviewed Guardian background website and it was determined that S1 does not have a criminal background clearance, therefore not allowed to provide direct care and supervision to C1. Based on record reviews and interviews this allegation is deemed substantiated.

A civil penalty was issued. Exit interview conducted and copy of report provided to Administrator.
