The inspector’s account

On 12/01/23, LPA Panushkina initiated the complaint. LPA conducted tour of the facility and obtained copies of pertinent information which includes, but not limited to Physician’s Report dated on 10/04/2023, Admission Agreement dated on 09/11/2023, Appraisal Needs and Services Plan/IPP dated on 03/23/2021 and reviewed a letter from C1 to C2 dated on 09/13/23. LPA also conducted an interview with the Administrator, four (4) staff and three (3) out of four (4) clients, who were able to communicate.

Investigator Hector conducted interviews with C2 and the Administrator on 12/07/23. Investigator also interviewed C1 on 12/26/23.

The investigation findings revealed that C1 moved to this facility 9/11/2023. C1 communicates with American Sign Language (ASL). Investigators’ interview was conducted by text message, C1 revealed that back in August 2022, C1 was attending a Day Program, where C1 got first introduced to C2. During an interview with the Investigator, C1 denied ever dating C2. However, during the initial visit made on 12/01/23, by LPA Panushkina, evidence received revealed that there was a relationship before C1 moved to this facility. C2 also informed the Investigator that few days after C1 moved to Bru #2, they began dating. In addition, interview with C2 revealed that they were never intimate and the only physical contact between the two was holding hands and that C2 kissed C1 only once, and it never escalated beyond that. C2 also confirmed during the interview with the Investigator that there has never been any sexual contact with C1. During the initial visit, conducted by LPA Panushkina, interviews with the Administrator, four (4) staff members and C4 revealed that sometime in October 2023, C2 started dating another person and all parties interviewed denied the above allegation. Additionally, one (1) out of three (3) clients interviewed did not witness anything nor did they hear the staff members forcing C1 and C2 to have sex. Client also stated: “All staff here are nothing but good to us. They are great and very well trained.” Based on interviews gathered during this investigation, there is not sufficient evidence to support the allegation. Therefore, this allegation is Unsubstantiated at this time.
