Complaint Investigation Report
The LPA attempted to interview R1 about the incident, but R1 declined to speak to the LPA, however R1 did state that no one hit them and they don’t want to waste their time speaking with the LPA. The LPA interviewed the Administrator about the incident, and the Administrator stated that they became aware that S1 had hit R1 through a telephone call with R1’s provider. The Administrator interviewed and R1 denied S1 hitting them and stated that they did not like S1 and wanted another one-to one. No other residents have reported that S1 was physical with them. The LPA was unable to reach S1 for an interview. The LPA interviewed the RP on 10/07/2024 about the incident reported by R2 to the RP. The RP stated that R2 could not provide specifics (time, date, place) about the incident, furthermore the RP stated that R2 stays mostly in their room with their private companion. Per the RP, they interviewed R1 about the incident reported by R2. The RP asked R1 if this has happened in the past? and R1 stated, "no. not really". R1 said that they had come back from the community, when S1 decided to search R1's backpack, R1 tried to stop S1 from searching the bag, and this is when according to R1, S1 hit them in the back. The LPA interviewed additional residents, and the residents stated that S1 has always been nice to them.
Although the allegation may have happened or is valid, based on the information gathered through interviews there is not sufficient evidence to prove the alleged violation did or did not occur, therefore the allegation is deemed Unsubstantiated at this time.
Facility staff searched resident’s belongings without consent.
On the allegation that Facility staff searched resident’s belongings without consent. it is the concern of the RP that the facility staff searched R1’s belongings without consent. LPA Urena interviewed the RP, and the RP said that through an interview done with R1, R1 claimed that staff was going through their backpack when R1 returned to the facility after an outing. Furthermore, the RP said that R1 claimed that they (R1) likes to steal; therefore, staff search R1’s backpack when R1 returns from the community outings. The Administrator’s interview revealed that R1 likes to go out to the community on their own, and often R1 will bring back weapons and other items (drugs) that may be dangerous to R1 and to the other residents in the facility.
