Complaint Investigation Report
In regards to the allegation: Facility staff member sexually assaulted resident while in care. The department interviewed the reporting party, three (3) facility staff, two (2) clients, two (2) Regional Center staff and review local law enforcement records. There were no witnesses to the alleged sexual assault allegation. Staff that were interviewed indicate that there are always numerous staff members continuously present at the facility and none of the staff was able to corroborate the allegation of sexual assault. Client #1 indicated that staff would not put their hands on Client #1. Client #2 indicated that the allegation was false. According to Client #1's Regional Center, Client #1 has a history of fabricating stories and has made similar allegations in the past. Local law enforcement investigation was closed and indicated there was no merit to the allegation. Therefore, the investigation did not reveal did not reveal a preponderance of evidence to support the allegation: Staff sexually assaulted a resident while in care.

According to client #1 Regional Center, Client #1 has a history of fabricating stories and has made similar allegations in the past. Local law enforcement investigation was closed and indicated there was no merit to the allegation. Therefore, the investigation did not reveal a preponderance of evidence to support that the allegation: Staff hit residents while in care.
Based on the department's interviews and record review, the investigation revealed: Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
