Complaint Investigation Report
During interviews with the clients, none of them corroborated the allegation. C1 did not corroborate the allegation during their interview that they have been hit by staff. C2 stated that none of the staff have ever hit any of the clients in the facility. During interviews with the staff, none of them corroborated the allegation. One of the staff stated that they have not and would never hit or slap C1. Another staff interviewed stated that they have worked with C1 at their previous assisted living facility and none of the staff have never hit her either at the previous home or the current one. LPA did not observe any signs of physical injury on C1.
In regards to the allegation that " Staff utilized an inappropriate form of discipline with resident in care," it is alleged that staff have physically disciplined C1 in the past at night including hitting them with a cane or shoe. During interviews with the clients, none of them corroborated the allegation. C1 did not corroborate that they have been physically disciplined at night by staff members. C2 stated that none of the staff have physically disciplined any of the clients in the home. During interviews with the staff, none of them corroborated the allegation. LPA interviewed night staff and they stated that they do not physically discipline C1 and understands it is their right to be free from unusual discipline. Another staff member stated they have never witnessed any staff physically disciplining C1. During the tour of the facility, LPA did not observe any dangerous items including a cane that can be used for physical discipline.
Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are UNSUBSTANTIATED.
An exit interview was conducted. A copy of this report, along with the appeal rights, was provided.
