Allegation: Staff unlawfully evicted a resident
On 12/13/2024 LPA Bunker reviewed facility records and found no eviction letter on file for resident 1 (R1).
On 12/13/2024 LPA Bunker conducted an interview with Licensee/Administrator Beverly Brinson who stated that the facility did not unlawfully evict the resident. Administrator stated she answered all calls and did not refuse to allow the resident to return. S1 stated that the resident is scheduled to return to the facility on Saturday morning, December 14, 2024, at 10:00 A.M. S1 denied the allegation. On 12/13/2024 LPA Bunker spoke to Witness 1 (W1), who stated resident was admitted to College Medical Center on 12/03/2024 and as of 12/11/2024 was ready to be discharged to his boarding care facility. Licensee/Administrator refused to allow resident back into the facility and would not find an alternative placement and no longer answered the phone when follow-up calls were made. On 12/13/2024 the department spoke to witness 2 (W2), who confirmed R1 was ready to return to facility as of 12/11/2024 and facility staff refused to allow him back.
Based on the department observations, interviews that were conducted, and records reviewed, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated.
