Complaint Investigation Report
The Department interviewed licensee staff #1 (S1) who stated the facility landline telephone and facsimile lines were down from 09/22/22 through 10/08/22. (S1) stated the lines were non-operable due to mechanical power failure caused by a fire in a neighboring street that affected the phone line systems. An interview with administrator staff #2 (S2) stated that the facility had no control over the phone lines not being in service. (S2) made several reports with AT&T telephone company, however, they were unable to provide him a time for when the services will be back in operating condition. (S1-S2) stated that the facility has a pay phone available for clients as an alternative. Pacific Telephone, a private company, owns the pay phone and it was working between 09/22/22 and 10/08/22.
The Department contacted AT&T telephone company and verified with witness #1 (W1) that the telephone landline account is in good payment standing and that services have not been interrupted. The account shows service calls for repairs, according to AT&T on record.
Interviews conducted with clients #1- #5 (C1-C5) claimed they all have their cellular phones and did not need to use the facility phone or the pay phone offered by the facility. (C1-C5) did not know whether the landlines at the facility were operable or not. Clients #6-#7 (C6-C7) refused to be interviewed or provide any information. The Department inspected landline phones on 10/17/22, and found the office and kitchen phones in working condition. The facsimile line is operable. A test was conducted on the pay phone, and it was found to be functional.
Based on the information gathered, an inspection of the facility, observation, analysis of records, and interviews conducted, the Department found no evidence to support the allegation mentioned in this complaint.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation, did or did not occur, therefore the allegation is Unsubstantiated.
No deficiencies were cited during this visit.
