Complaint Investigation Report

EA observed that next door to this HCO is a business called Mae Morgan Staffing which is owned by licensee’s wife which is under a different corporation as this HCO. Mae Morgan Staffing is a referral agency whose primary business is referring clients with caregivers who are independent contractors. Licensee stated the HCO was established to assist with his wife’s business in case any of her clients wants to sign up with an HCO instead of dealing directly with the caregiver. Licensee has not had any clients since its inception and no home care aides employed, no payroll records could be provided for review. Licensee’s wife provided EA with a copy of the domestic worker agreement signed by the HCA who disclosed the information to the RP with Mae Morgan Staffing.

Based on the evidence gathered and interviews conducted, the preponderance of evidence standard has not been met, therefore the above allegation is found to be UNSUBSTANTIATED.

EA concluded the visit with an exit interview and provided a copy of this report along with appeal rights to the licensee.
