The inspector’s account

The HCO stated that they explained the safety concerns for their workers to the client, sought alternative HCAs for the client, and that the HCO followed the required state and federal labor laws as related to worker safety.

Per the California and federal labor law requirements reviewed, employers are required to provide employees with work sites that are free from recognized hazards that are causing or are likely to cause death or serious physical harm.

Based on the EA's observations, interviews and records review, there was insufficient evidence to prove the allegation as the preponderance of evidence standard was not met although the allegation may have happened or is valid, therefore the allegation is found to be unsubstantiated.
