The inspector’s account

LPA interviewed Staff #1 - #5. S1 denied pinning C1 to the ground or biting the client. Two other staff who witnessed the incident stated S1 did not bite, scratch, or hold the client down. They observed C1 attacking S1, and they both fell to the ground while in the living room. The client also pulled S1’s necklace and broke it. Staff #2 tried to intervene and was kicked by the Client. They did not restrain the client and only used verbal redirection with them. The local police officer visited the facility and interviewed C1 on 4/21/25. They did not not suspect any abuse from staff. According to the facility notes, after the officer left, C1 was apologetic to staff for fabricating the stories. Other staff interviewed have not observed or heard about a staff causing harm to a client. LPA interviewed 4 clients. C1 confirmed that staff did not bite or hold the client down. The other 3 clients interviewed stated they saw C1 attacking S1, but the staff did not touch the client. They stated staff do not harm them in any way and like living at the facility.

LPA reviewed C1’s Positive Support Plans 2024 and the Second Quarter Behavioral Services Report, and both indicated the client exhibited behaviors of fabricating stories.

The San Gabriel/Pomona Regional Center also investigated these allegations and did not substantiate on physical abuse.

Allegation - Staff retaliated against the client. It is alleged that Client #1 (C1) was not given an Easter basket or allowed to go out for dinner as a result of the aggressive behavior. LPA interviewed Staff #1 - #5, who stated they do not retaliate against the clients. They treat them fairly and do not punish them for exhibiting behaviors. All the clients were given an Easter basket. They do not exclude any clients from going on outings. The clients are given an option of whether they want to go out to dinner. 3 out of 4 clients interviewed stated that they do not feel staff retaliate against them. They feel that staff support them when they engage in their behaviors and are treated with respect.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are UNSUBSTANTIATED.

An exit interview was conducted with the administrator. A copy of this report, along with the appeal rights, was provided.
