Complaint Investigation Report
The investigation revealed the following: in regards to the allegation "Staff interfered with client’s visitation rights.” It is alleged that the facility did not allow the visitors inside the home during visits. When they ask to come in, they are required to wait in the kitchen, and they are not allowed to visit the client’s room. They were required to pick up and drop off the client outside the home and call ahead to schedule visits. All staff interviewed denied the allegation. All staff interviewed indicated that visitors are allowed to visit at any time but as an recommendation and courtesy, they asked the visitors to contact the facility prior so that they can prepare and make sure that the client is home. LPA reviewed documentation of one visitor contacting the facility providing advance notice that they will be visiting and picking up their loved one as a courtesy but not a requirement. LPA also reviewed the facility’s visitor policy which states that clients have the right to visitors in which individuals are able to have visitors of their choosing at any time. Visitor Policy continues to state that individuals in the home will set their own House Values on visitors as they see fit. LPA attempted to interview two (2) out of six (6) clients but was unable to interview since they were all out of the facility and in the community. However, LPA interviewed four (4) out of six (6) clients and the clients denied the allegation and stated that the visitor can visit at any time. LPA interviewed three (3) out of three (3) witnesses and all witnesses stated that visits are allowed at any time but were informed by the facility as a recommendation to contact the facility in advance so that the facility can prepare and ensure that the client is home and available. Based on interviews conducted with facility staff, and facility clients, and record review, there was not enough supportive evidence to concur with the reported allegation.
Allegation: “Staff spoke inappropriately to client in care.” It is alleged that a facility staff speak inappropriately and bully clients in care. Interviews conducted with Admin, Licensee, and two (2) out of two (2) staff revealed that the facility staff do not speak inappropriately and does not bully the clients. Admin and Licensee also stated that there have been no written warnings issued to any staff regarding speaking inappropriately or bullying the clients. LPA attempted to interview two (2) out of six (6) clients but was unable to interview since they were all out of the facility and in the community. Interviews conducted with four (4) out of six (6) clients revealed that the facility staff does not inappropriately or bully the client. LPA interviewed three (3) out of three (3) witnesses and all states the clients have not been spoken inappropriately to or bullied. LPA also reviewed ongoing staff training on abuse prevention, client rights, and personnel policies. Based on interviews conducted with facility staff, facility client, witnesses, and record review, there was not enough supportive evidence to concur with the reported allegation.
