The inspector’s account

Regarding allegation “ Due to staff negligence, clients were locked out of the day program for an extended period of time”: it was reported that staff and disabled clients were locked out of the facility past the scheduled start time of 9am. Facility gates and doors were locked, staff and clients remained outdoors in the parking area creating an unsecured environment. Staff and clients remained outdoors for about 40 minutes until staff with keys to open the facility arrived to unlock the gate and doors. Lack of access resulted in client altercation.

The investigation revealed (6) out of (6) staff interviewed confirmed the facility was locked and inaccessible to clients at 9am, when clients are scheduled to begin arriving. (5) out of (6) staff stated this had not happened before. (3) out of (6) staff stated the gate to the patio and facility doors were locked until about 9:40am when a staff member with keys arrived to unlock the gate and facility doors. (2) out of (6) stated the facility doors were locked at 9am, however, the matter was handled in a timely manner, and clients were not unsupervised and being attended to by staff on site. All staff interviewed indicated that nobody was allowed entry to the facility at 9am on 02/06/2026 during business hours. Per interviews conducted, 3-4 staff were on site and about 10 clients were in the parking lot and patio area. LPA attempted to interview clients. Due to cognitive ability, clients were not able to answer LPA’s questions.

Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated.

Per California Code of Regulations, Title 22, deficiencies are being cited on the attached LIC 9099D.

Exit interview held, and a copy of this report and appeal rights provided to Assistant Program Director.
