Complaint Investigation Report
Interview with HCA who completed the employment history and provided it to RP stated he worked for this HCO from 2017 through 2019 as a W2 employee, not an independent contractor, however, HCA did not have any tangible proof that he worked for this HCO as it had been several years since. Additionally, HCA did not seem certain this was the HCO he worked for as this HCO is part of a franchise.
When interviewed, the licensee, staffing coordinator, the accounting administrator did not recall the name of the HCA in question , however a review of HCO records indicate HCA turned in an application to this this HCO on 4/21/23 but was not hired as he did not complete all requirements including the home care aide registry. Additionally, EA reviewed the HCO's financial records from 2017 through 2019 which did not indicate HCO was hiring independent contractors. Additionally, financial records reviewed did not corroborate information HCA provided that he worked for this HCO as a W2 employee because HCA's name was not in any of the financial documents reviewed.
Based on interviews conducted and documents reviewed, EA concluded that there was not enough evidence to show that the organization violated any of the allegations listed above, therefore, the above allegations are found to be UNSUBSTANTIATED.
EA concluded the visit with an exit interview and provided a copy of this report along with appeal rights to the licensee.
