Complaint Investigation Report
The investigation revealed the following:
Allegation: Staff did not prevent inappropriate interaction between clients.
It is alleged that Client #2 (C2) inappropriately touched C1 while giving C1 a hug and touched their buttocks. LPA interviewed 4 staff and each denied the above allegation. Interviews with Staff #1 (S1) and S2 revealed that law enforcement has investigated this allegation and investigation was left inconclusive. Interview with S3, who worked directly with C1 the day of the alleged incident, stated that they did not see the two individuals have any interactions that day, that the group was 3 clients/2 staff and were on an outing during that day, once returned to the facility clients were in the cafeteria with no other clients and C2 was not within the group for the day. S4 who works directly with C2 states that they have never observed any interactions with the two individuals where they would be close enough to touch one another, however, does recall a day (unsure of exact date) where C1 asked C2 if they could sit by them and C2 did not want C1 to sit next to them answering in a rude way, redirection and reminders of being kind when responding to people were given to C2, there were no further incidents besides this. LPA reviewed file for C2 and there was no history of inappropriate touching or interactions of this sort documented within file, additionally, staff interviewed also confirmed that they have never witnessed or heard of C2 touch anyone inappropriately. LPA reviewed C1's file, there were notes within file of fabrication and reports of false allegations when C1 is upset or does not get their way. LPA interviewed 5 clients and 5 out of 6 clients stated that they have never been inappropriately touched by peers or staff at facility and feel safe at the facility. Interview with C2, they denied the above allegation and stated that they have never touched anyone in any private areas and do not know who C1 is.
Based on statements and interviews conducted with staff and clients, and review of client files, there was not enough supportive evidence to concur with the reported allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED .
