The inspector’s account

Investigation revealed the following: Regarding allegation, Staff are harassing resident , it is alleged that facility staff is harassing facility clients and constantly writing clients up for things they did not do and are constantly going after clients for things they did not do. Interviews conducted with Administrator Santos and Assistant Administrator Sapugay revealed that facility staff do not harass or go after any clients for things they did not do. They stated that staff will talk to clients if they are not following house rules for example having drugs in the facility, illegal medications, having weapons, having visits in their rooms, having overnight visits and smoking in their rooms. They stated that all clients have a copy of the house rules, and all of them signed and agreed to them. They also stated that if any client is not following any of the house rules the enforcement of the house rules consists of issuing two warnings and the third warning is an eviction notice. Interviews conducted with 5 out of 7 facility staff revealed that they are not aware of any client being written up or issued warnings for things they did not do. They stated that if a client breaks any house rules they are issued two warnings before being served with an eviction notice. Interviews conducted with 9 out of 10 clients revealed that they are aware of the house rules and know that if they break any house rules they will be issued warnings before being given an eviction notice. 2 out of 10 clients revealed that they have not been served any warnings without a valid reason. 7 out of 10 clients stated that they have not been harassed by facility staff. 2 out of 10 clients stated that staff will remind them constantly about the house rules but stated that they did not think it was in a persistent or harassing manner. LPA reviewed a copy of the facility house rules and observed that enforcement of facility house rules consists of the issuing of two warnings before the third notice which is an eviction notice. Based on LPA review of documents and statements gathered from interviews conducted with staff and clients there was not enough supportive evidence to concur with the reported allegation.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED .
