The inspector’s account

When a resident is observed by staff for smoking indoors or their rooms the manager is quick to investigate, the residents are reminded of the house rules and violation notice is given to the resident and communicated to their POA. According to the staff, residents that violate the house rules for similar issues are reminded constantly, staff has posted ‘No Smoking” signs near and in suspected smokers’ rooms to remind residents of the no smoking rule. A few residents interviewed state they have smelled cigarette and marijuana smoke around the facility but not seen anyone smoking indoors. Based upon interviews and observations conducted the findings indicate that, although the allegation(s) may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.
