09/13/2021 and conducted by Evaluator Lady Cabrera

COMPLAINT CONTROL NUMBER: 24-AS-20210913163719

Staff physically abused resident while in care

Licensing Program Analyst (LPA) L. Cabrera conducted the subsequent complaint investigation visit to the facility. LPA met with Licensee Rosalina and Tony Nankil. Administrator was unavailable.

The Department determined based on the interviews and records review that the above allegation is SUBSTANTIATED. Based on interviews conducted there was sufficient evidence to corroborate that Staff hit Client (C1) with a belt on 05/20/2020. C1 confirmed being hit by staff. The Staff’s report of the incident was inconsistent and denied the allegation. Based on the Department observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

A copy of this report and Appeal Rights have been provided and an exit interview was conducted with Administrator.
