The inspector’s account

was 120 degrees Fahrenheit. Using the same temperature gun, LPA determined that the temperature inside the facility was 76 degrees Fahrenheit. LPA observed that the facility had a thermostat, and it was set to 75. Interview with Program Director indicated that the building is leased, and the air conditioner (AC) is maintained by the landlord.

On July 12, 2023, facility staff noticed that the facility was getting hot before noon. The thermostat read 86 degrees Fahrenheit. Around noon, Program Director and staff contacted transportation for clients to leave facility. That next day, Program Director found out that the AC breakers were not functioning and was in the process of getting fixed by the landlord. Program Director sent an email and text message to client’s responsible parties of adjusted hours due to the AC being out of service. Program Director employed the use of four (4) portable AC units and fans to regulate the temperature inside of the facility. AC was fixed by July 14, 2023.

Based on the evidence obtained during the complaint investigation, the allegation that facility did not maintain a comfortable temperature in the facility is found to be UNSUBSTANTIATED, meaning that although the allegation may have happened or may be valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. An exit interview was conducted with Program Director; a copy of this report and Licensee's Rights (LIC9058) were provided.
