Home Care Services Branch (HCSB), Enforcement Analyst (EA) Megan Vigil, arrived at location of Home Care Organization (HCO) for the purpose of a complaint investigation on 6/12/2024.

EA Vigil was greeted by Designee, Kelsey Chavez. EA Vigil requested the records needed to complete a file review. Chavez explained they do not have access to the records but could speak with the Operations Manager, Kathy Keen, over the phone. EA Vigil requested access to the digital files, but Keen denied access and stated they would send digital files via email from the corporate office in Tennessee. Keen sent some records, but the documentation could not be reviewed and needed to be available on site. EA Vigil advised Keen over the phone, if the Designee could login to the programs/system, we could complete the review. Keen denied access to records for the second time. EA Vigil was unable to review the records and could not complete the investigation which resulted in multiple citations in addition to the allegations. It was found, through evidence and interviews conducted, Licensee Louis Tapia, continued to operate at two unlicensed locations after being cited for operating an unlicensed home care organization.

Based on the EA’s interview and evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. A copy of 809, 809D reports and appeal rights were provided. Exit interview.
