08/11/2021 and conducted by Evaluator Tiffany Holmes
COMPLAINT CONTROL NUMBER: 08-AS-20210811093933
Licensing Program Analyst (LPA)Tiffany Holmes contacted the facility to deliver findings for a complaint investigation via tele-virtual. LPA identified herself to, and explained the purpose of the visit and the basic elements of the complaint with Kim Keene, Director of Programs.
On 08/20/2021, LPA Ruiz conducted a tour of the facility, interviews and reviewed records. It was alleged that licensee did not protect clients in care. Interviews revealed that Client 1 (C1) was not able to provide any information regarding the allegation. Interviews with staff could not prove that the licensee did not protect clients in care. Interviews revealed that the client has lived in the memory care unit for over 6 years and that they have not been aggressive with the other clients. Interviews revealed that the client would not be able to speak on any incidents that have occurred due to their condition. Interviews revealed when the client first moved in they were physically and verbally aggressive with staff and verbally agressive with the clients. Interviews revealed when the staff observed C1 being verbally aggressive with other clients they would separate the clients and redirect them. Interviews with an outside source revealed that the client may have tried to be aggressive with clients but they were aggressive with staff only. Outside source also revealed that there werent any clients that were harmed by C1. The investigation did not produce supporting evidence or supporting witness statements to substantiate that the licensee did not protect the clients in care.
Based on the evidence obtained from interviews,the complaint allegation is unsubstantiated. The allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.
An exit interview was conducted with Kim Keene, Director of Programs and a copy of this report along with Licensee/Appeal Rights (LIC 9058 03/22) was provided at the conclusion of the visit.
