Complaint Investigation Report
Per a Fire Inspection Request (STD. 850) dated 08/14/2023, the facility was granted a fire clearance to operate an adult day program for 40 clients from 8:00 a.m. to 5:00 p.m. from Monday through Friday. LPA reviewed the facility sketch, toured the facility, and observed a gate allowing entry into the day program. Prior to entering the gate, LPA observed parking spaces designated for other businesses on the north and south ends. While inside the gate, LPA observed parking spaces on the north, a basketball hoop on the east, and the day program building on the southeast side. On 07/23/2025 and during today’s visit, LPA observed C1 present lying on the parking lot asphalt near the basketball hoop supervised by a staff.
Administrator Munoz was interviewed and reported the following information. C1 enjoys lying in the parking lot asphalt and is supervised by staff. He supervised C1 on the incident dates and times. The day program gates open at 8:30 a.m. From 8:30 a.m. to 9:00 a.m., clients already present at day program are escorted into the building before vehicles enter the parking lot to drop off any additional clients. Staff close the parking lot gate from 9:00 a.m. to 1:55 p.m. to ensure the safety of the clients who prefer being outside. Only authorized vehicles such as those of day program employees, placement and licensing agency staff may enter the parking lot from 9:00 a.m. to 1:55 pm only after all clients on or near the parking lot are escorted into the day program building. Anyone dropping off clients after 9:00 a.m., is made aware they must wait outside of the gate until they are met by a day program staff. Visitors and transportation drivers will send a message to Administrator Munoz or get the attention of nearby staff to be granted entry. On the alleged incident dates and times, no unauthorized vehicles entered the parking lot when C1 was lying on the floor or when any of the other clients were outside. The facility provides clients who enjoy being in the parking lot with a hat and non-toxic sunscreen and facility staff are consistently encouraging these clients to drink water, go under the shade, join in the available activities or offer alternative inside the building.
