This is an official report of an unannounced visit/investigation of a complaint received in our office on

08/19/2024 and conducted by Evaluator Mary Garza

COMPLAINT CONTROL NUMBER: 24-AS-20240819170620

Licensee did not seek medical attention in a timely manner.

On 10/31/2024 Licensing Program Analyst (LPA) M. Garza completed an unannounced complaint visit. LPA met with Licensee, Dale Martinez, explained reason for visit and was permitted entry into the facility. A health and safety check was completed on residents in care. Residents observed in common areas.

During investigation interviews were completed with staff and documentation (resident roster, staff schedule, and contact information, SIR's for R1, hospital discharge records for R1, IPP and medical care plan) was reviewed. Documentation showed that R1 has a history of seizures. Interviews with staff disclosed that R1 had not has a seizure for many years. Although EMS was not contacted, interviews with staff disclosed the facility took appropriate action and assisted R1 during their seizure R1 was then taken for immediate medical attention.

Although the allegation may or may not have occurred, the preponderance of evidence standard has not been met per Title 22. The complaint allegation is UNSUBSTANTIATED. No deficiencies cited during todays visit. Exit interview completed with Administrator, Dale Martinez. A copy of this report provided.
