Interviews with S1–S3 also confirmed that S4, S5, and S6 restrained the resident while in the second-floor memory care unit. Review of the documents indicated that the resident remained restrained overnight, which led to disciplinary action and termination of the involved staff members.

Based on LPA's interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations (Title 22, Division 6, Chapter 8), are being cited on the attached LIC 9099D
