The inspector’s account

7 residents interviewed corroborated that R1 engages in inappropriate behaviors and multiple residents interviewed stated that R1 has hit other other residents in the past. Per AD, R2 does drugs outside the facility, vandalizes their room, is abusive to other residents, is loud, slams doors, and the facility has received complaints about R2 from other residents. 5 residents interviewed corroborated that R2 engages in inappropriate behaviors and multiple residents interviewed stated that R2 has a history of drug use, screaming, threatening, and other disruptive behaviors. Per AD, R3 wanders into other residents’ rooms, steals toilet paper, and engages in other inappropriate behaviors. 5 residents interviewed corroborated that R3 frequently clogs and floods the plumbing, refuses to bathe, has set a fire in the bathroom, yells, and that residents have complained to the facility about R3’s inappropriate behaviors. AD stated that the facility has in the past served eviction notices on R1, R2, and R3, but did not follow through with legal evictions and therefore allowed these residents to continue to live at the facility despite engaging in appropriate and disruptive behaviors.

During inspections, LPA observed that the facility’s food portions are medium to large sized and observed a general balance in dietary requirements. LPA observed 1 staff at the front door of the building acting as a security guard, signing residents in and out of the facility. LPA observed 1 staff coordinating activities and engaging with residents along with a posted activity calendar. LPA observed the kitchen to be clean and organized and observed no health and safety issues. LPA inspected the first floor, second floor, kitchen, laundry room, resident rooms, common areas, and bathrooms and observed no health and safety issues. 3 residents interviewed stated that the facility is a safe and comfortable place to live. However, 4 residents interviewed stated they did not feel safe and comfortable living at the facility due to the behaviors of R1, R2, and R3 and similar behavior. 2 residents stated they are afraid of R1, R2, and R3 and that they have been hit by other residents at the facility. By allowing R1, R2, and R3 to continue living at the facility, the facility did not provide a safe and comfortable environment for other residents.

During the course of the investigation, the Department obtained sufficient evidence to substantiate the allegations mentioned above. The preponderance of evidence standard has been met; therefore, the above allegations are Substantiated. See LIC9099D for cited deficiencies per Title 22 Division 6 of the California Code of Regulations. Based on review of the facility's compliance history, which revealed the licensee was cited for the same violation within the last 12 months, civil penalties in the amount of $250 per repeat violation are being assessed. Civil penalties of $100 per day, per violation will accrue until the deficiencies are corrected. See LIC421FC. An exit interview was conducted and a copy of this report and appeal rights was discussed with and provided to facility representative.
