Staff failed to stop resident from smoking in his room.
Licensing Program Analyst (LPA) Jerome Haley made unannounced visit to start the investigation for a complaint received March 13, 2024. LPA Haley was greeted by staff and explained the reason for the visit.
Regarding the allegation: Staff failed to stop resident from smoking in his room.
During the investigation six interviews were conducted, including interviews with facility staff, clients, and witnesses. 5 of 6 individuals confirmed the complaint allegation above. S1 acknowledged residents smoke in their room and have been given warnings. Client 1 (C1) and (C2) both admitted to smoking in their room and C1 admitted their roommate Clinet 3 (C3) smokes in the room all the time, and admitted to being verbally warned about smoking in the room. C1 is aware of the designated smoking area on the side of the facility.
Based on the evidence gathered during interviews, and document review the preponderance of evidence standard has been met, therefore, the above allegation is found to be SUBSTANTIATED. Violations are being cited per California Code of Regulations Title 22, Division 6.
