Complaint Investigation Report
Six out of six staff interviewed denied ever witnessing a client by hit by another client. The six staff interviewed also stated that the facility has a zero-tolerance policy against physical violence and that if such an incident occurred, it would lead to suspension or removal from the facility.
Regarding the allegation that, staff speak inappropriately to clients, the following has been concluded: It was alleged that C1 was spoken to inappropriately by a facility staff. LPA was unable to conduct an interview with C1 for this complaint due to C1 leaving the facility on April 8, 2022. LPA conducted five client interviews. Five out of the five clients interviewed denied ever being spoken to inappropriately by a facility staff. The five clients interviewed also denied ever witnessing such an incident occur. LPA conducted six staff interviews. Six out of the six staff interviewed also denied ever witnessing a staff speak inappropriately to a client.
Based on the evidence gathered during the investigation, the Department is unable to ascertain if the allegations occurred as reported. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove or refute the alleged violation occurred; therefore, the two allegations are deemed UNSUBSTANTIATED. An exit interview was conducted with Director of Operations Eric Lopez and a copy of the report was provided.
