Complaint Investigation Report
Regarding allegations. Staff did not treat client with dignity or respect and did not follow client's behavioral plan. It was alleged that S1 behaved rudely toward C1. Incident was recorded by C1 and the footage showed C1 approaching S1 while recording, and the staff responded with raised voice and negative verbal engagement and not adhering C1’s behavioral plan.
LPA review the video provided by C1. The video showed how S1 is yelling at C1 and threatening C1 that they will call the police when C1 will not stop to record them. Also it clearly shows on the video how S1 caricatures, parodying C1 and gesturing angrily pointing their finger at C1’s face. Then S1 follows C1 toward clients bedroom and continues to yell at C1, forcing C1 to get their medication and C1 telling S1 to give them space and they will take the medication. S1 continuing to yell, raise their voice at C1 escalating the situation and not adhering to C1’s behavioral plan. LPA review C1’s Individualized Program Plan (IPP) and Behavioral Plan, which indicates that C1 has a history of resistiveness / non – compliance behavior and Photographing / Videoing others without consent, and when those behaviors appears staff will redirect C1 calmly and to be model how to interact in a calmer manner. Also provide choices to provide C1 with some control over their situation. Interviewed Administrator stated that on 03/17/26 received an update from S1 that C1 is giving hard time to take their medications. Interviewed S1stated that C1 didn’t take their medication after 3 reminders and started to take a video following S1. S1 stated that they verbally prompted C1 to stop harassing, following staff. Interviewed S2 stated that on 03/17/26 around 9:30 pm S1 reminded C1 to take their medication, but C1 said give them more time and started to record S1. Interviewed S3 stated that during the incident between S1 and C1 they were not there and not sure what happened. Next day C1 told S3 about the argument but didn’t show the video. LPA interviewed C1 and C2. C1 showed the video to LPA and stated that on 03/17/26 S1 started to yell on them and C1 thoughts that because they didn’t take 8:00pm medication but later at 9:30 they took it. Interviewed C2 stated that they don’t know what happened between C1 and S1.
Based on LPA's observations, record reviews and interviews the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated.
Exit interview conducted and the copy of this report with Appeals Right were provided.
