Complaint Investigation Report
It was reported that staff take away resident’s cell phone and tablet every day. Interviews conducted with staff revealed that Resident #1 (R1) has both a personal cell phone and a tablet, which they are able to use daily. Staff confirmed that R1 turns in these devices at the end of each day to be locked away. Staff stated that there were prior concerns regarding R1 using their devices to communicate with strangers late at night and inviting them to the home. Staff further stated that these concerns were communicated to both R1’s family and R1’s service coordinator, who approved staff removing the devices from R1’s possession at night. Per R1’s Individual Program Plan Amendment dated 03/13/2026, it states that due to R1 using their cell phone to engage with men on the internet and inviting them to the home. they have implemented a safety measure of locking away R1’s cell phone during the night hours between 10pm and 6am. To which R1 has agreed to maintain both their safety and the other residents living at the facility. During an interview, R1 confirmed that they are able to use their cell phone and tablet daily. Based on the information obtained and reviewed, there is not a preponderance of evidence to prove the alleged violation did occur, therefore allegation “staff do not allow resident to possess personal belongings” is deemed Unsubstantiated at this time.
It was alleged that staff violated residents’ personal rights. It was reported that staff do not allow residents to shower whenever they choose. Interviews conducted with staff revealed that all residents prefer to shower at night before going to bed, with the exception of one resident who prefers to shower in the morning before attending day program. Staff stated that residents are able to choose when they want to shower and that they are not restricted or told when they can or cannot shower. Interviews conducted with residents revealed that two out of two residents did not express any concerns about showering whenever they pleased. Furthermore, during the interviews, residents denied the allegation that staff has ever prevented them from showering at any time while living at the facility. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore allegation “staff violated residents’ personal rights” is deemed Unsubstantiated at this time.
