Complaint Investigation Report
It was alleged that a sexual abuse occurred to female clients by the Director of Occupational Therapy (DOT), who is allowed to conduct physical assessments on unclothed female clients. Interview with the Administrator, conducted by LPA Panushkina, during the initial visit, revealed that prior to employment all staff members must receive a various training on “Care and Supervision,” “Personal Rights,” Mandated Reporter,” etc. Administrator also informed the LPA that prior to clients being evaluated/assessed an approved consent must be received by the client/legal guardian. If the client does not wish to be assessed or re-evaluated, the DOT will not make any visitations. Moreover, interview with the DOT revealed that prior to the assessment/evaluation of the client, he/she contacts the facility to schedule a visit and once at the facility, the DOT makes an observation on how the staff members provide care to the client. The DOT informed LPA that during the assessment/evaluation of the client, one (1) or two (2) staff members are always present, and his/her main job is to make an observation on how the clients are being handled by the facility staff and to make necessary changes/advise/suggestion. The DOT stated: “With my assessments/re-evaluation we can get goals to increase our clients’ independence.” Interviews with four (4) staff members confirmed that during the DOT’s assessments a staff member must be present. All parties interviewed also confirmed that DOT only makes an observation, during the assessment and no physical contact between the DOT and female clients is involved. Lastly, the LPA conducted an interview with ten (10) out of eleven (11) clients and all clients denied the above allegation. Based on interviews and record review there is no sufficient information to verify this allegation. Therefore, this allegation is deemed Unsubstantiated at this time.
