The inspector’s account

During interviews with the clients, eleven (11) out of fourteen (14) did not corroborate the allegation. One of the clients stated that they feel that the intercom's volume is at an appropriate level and does not need to be higher or lowered in volume. Another client interviewed stated that the intercom system is fine and it is not too high or low in volume. During interviews with the staff, none of them corroborated the allegation. During interviews with S3, they stated that when they use the intercom to call residents at night they make sure to keep the volume low and do not yell into the intercom so that they don't startle any of the clients. Another staff member interviewed stated that they adjusted the intercom volume system as low as they possibly could, and cannot lower it anymore otherwise some of the clients may not be able to hear the announcements. During the physical plant tour of the facility, LPA overheard the intercom calling the names of some of the clients to come to the front office and found it to be an appropriate volume.

In regards to the allegation that " Staff did not prevent resident from being bullied by another resident," it is alleged that C1 had been bullied by C5, and that S4 observed this occurring but did nothing to prevent it. During interviews with the clients none of them corroborated the allegation. One client interviewed stated that they have never witnessed clients bullying one another in the facility. Another client interviewed stated that there are times where clients have threatened one another, however staff do intervene in these circumstances. During interviews with the staff, none of them corroborated the allegation. During interview with S4, they stated that C1 was never bullied by C5, and that during this incident C1 was using the facility phone for a call that took a long time and C5 asked C1 if they could also use the phone. Another staff interviewed stated they were not aware of any incidents of any clients bullying C1.

Based on statements and interviews conducted with staff, clients, review of client files and facility file records, there was not enough supportive evidence to concur with the reported allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED .
