The inspector’s account

Regarding the allegation: Staff did not intervene when client assaulted another client. It was alleged that one client bumped into C1 shoulder pushing C1 to the floor and called C1 “B” word couple of times. Staff was witnessed the incident and did not intervene. C1 called the police.

(4) of (4) Staff interviewed denied the allegation. (10) of (11) Clients interviewed could not corroborate the allegation. Staff interviewed denied the allegations and stated no knowledge of C1 was assaulted by another client. They indicated that they did not witness that any clients at the facility assaulted C1. Staff stated that if they witness an altercation between clients they will attempt to stop the altercation and will notify facility management immediately. Also they will contact Law Enforcement. Interviewed Administrator stated that there is no evidence or report of the incident and no call made to the Police. Staff stated that they didn't hear that someone called C1 "B" word. Clients interviewed indicated that they did not witness the alleged incident between C1 and another client and that someone called "B" word to C1. Interviewed clients indicated that they feel safe at the facility and staff very attentive and confirmed that facility staff will intervene during client on client altercations. Interviewed C1 stated that one client push them but couldn't confirm the clients name and the time when the incident was happened. C1 could not confirm that they called the police.

Based on statements and interviews conducted with staff, clients, review of client files and facility file records, there was not enough supportive evidence to concur with the reported allegations. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
