The inspector’s account

It is alleged that in the morning on 11/13/2025, a S1 pushed C1 and C1 fell on the floor and while C1 was on the floor, S1 stomped on C1. LPA interviewed C1 that corroborated with the allegation stating that S1 pushed C1 out of the bed and C1 went to the floor and S1 stomped on C1 on the floor. C1 stated that C1’s hand was injured. However, C1 did not report this to staff. LPA observed SIR dated 11/14/2025, the staff also observed no injuries at the time of the incident. C1 also stated there were no witnesses. LPA interviewed an additional one client that denied the allegations stating that they haven’t witnessed C1 or any client being pushed or stomped on by S1 or any staff on 11/13/2025. One (1) out of two (2) clients also stated not being pushed or hit by S1 or any staff. LPA interviewed S1 denied the allegation stated that C1 was having a behavior of being verbally aggressive and went towards C1 so S1 got out of C1’s way. S1 also stated of not touching, pushing or stomping C1. LPA interviewed the Licensee, Administrator, and an additional two (2) staff that denied the allegation stating that C1 was not pushed or stomped on the floor on 11/13/2025. One (1) of the three (3) staff witnessed the incident and stated that C1 had a behavior of being verbally aggressive and S1 did not physically touch, push, or stomp C1. LPA reviewed all documentation that C1 has a history of making allegations and fabrications. LPA also reviewed staff training on reporting and documenting abuse, and zero tolerance. There is not enough evidence to substantiate.

Based on statements and interviews conducted with staff, clients, review of client files and facility file records, there was not enough supportive evidence to concur with the reported allegation(s). Although the allegation(s) may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was held, and a copy of this report was provided to the Administrator, Daysi Galeano.
